Refund Policy

1. Overview

At Weblume ("Company," "we," "us," or "our"), we are committed to delivering exceptional design work and ensuring the satisfaction of every client. We understand that circumstances may arise where a refund request becomes necessary, and we have established this Refund Policy to provide clear and fair guidelines for all parties involved.

This Refund Policy applies to all services provided by Weblume, including one-time project engagements and monthly subscription plans. By engaging our Services, you acknowledge that you have read, understood, and agree to the terms outlined in this Refund Policy.

We strongly encourage all clients to communicate openly with our team throughout the design process. Clear communication and timely feedback are essential to ensuring that the final deliverables meet your expectations and minimize the likelihood of disputes or refund requests.

2. One-Time Project Refunds

2.1 Deposit and Non-Refundable Fees

For one-time project engagements, a non-refundable deposit of 50% of the total project fee is required before work commences. This deposit covers the initial consultation, creative direction development, research, and the allocation of resources necessary to begin your project. The deposit is non-refundable under all circumstances, as it compensates Weblume for the time, effort, and opportunity cost incurred in reserving capacity for your project.

2.2 Cancellation Before Design Commencement

If you cancel your project after paying the deposit but before any design work has been presented to you, the non-refundable deposit will be retained by Weblume. No additional charges will apply, and the remaining balance will not be invoiced.

2.3 Cancellation After Design Commencement

If you cancel your project after design work has commenced (i.e., after the first design concept or draft has been presented), the following terms apply:

  • The non-refundable deposit will be retained by Weblume.
  • You will be responsible for payment of all work completed up to the date of cancellation, calculated at Weblume's standard hourly rate or as a pro-rata portion of the total project fee, whichever is greater.
  • Any work-in-progress materials, preliminary designs, and concepts created up to the date of cancellation remain the property of Weblume unless otherwise agreed in writing.

2.4 Dissatisfaction with Completed Work

We strive to exceed your expectations with every project. Each project includes a specified number of revision rounds (as outlined in the project proposal) to ensure the final deliverables align with your vision. If, after exhausting all included revision rounds, you remain dissatisfied with the final deliverables, the following options are available:

  • Additional Revisions: Additional revision rounds may be purchased at Weblume's standard revision rate to further refine the deliverables.
  • Partial Refund Consideration: In exceptional circumstances where Weblume has demonstrably failed to deliver work consistent with the agreed-upon creative brief and project scope, a partial refund of up to 25% of the total project fee (excluding the non-refundable deposit) may be considered at Weblume's sole discretion. Such requests must be submitted in writing within 14 days of the delivery of the final files and must include a detailed explanation of how the deliverables deviate from the agreed-upon scope.
  • Full Refund: Full refunds are not available for completed projects. The nature of creative services means that significant time, expertise, and resources are invested from the moment work begins. By approving the creative direction and providing feedback throughout the revision process, you are actively participating in shaping the final deliverables.

2.5 Scope Changes and Refunds

If you request changes to the project scope after work has commenced that fundamentally alter the agreed-upon creative direction or significantly expand the deliverables, these changes may be treated as a new project or scope extension and will be quoted accordingly. Refunds will not be issued for work completed under the original scope if you subsequently decide to change direction.

3. Subscription Plan Refunds

3.1 Monthly Subscription Billing

Monthly subscription plans are billed on a recurring basis at the beginning of each billing cycle. Subscription fees are non-refundable for the current billing period once payment has been processed. This means that if you cancel your subscription partway through a billing period, you will continue to have access to the subscription services until the end of that billing period, but no pro-rata refund will be issued for the remaining days.

3.2 Subscription Cancellation

You may cancel your subscription at any time by providing written notice to Weblume. Cancellation will take effect at the end of the current billing period. Upon cancellation:

  • You will retain access to subscription services until the end of the current billing period.
  • All completed deliverables produced during your subscription will be delivered to you.
  • Any work-in-progress at the time of cancellation will be completed and delivered if it is within the current billing cycle's scope.
  • No further charges will be applied after the current billing period ends.

3.3 First-Month Satisfaction Guarantee

For new subscription clients, we offer a limited satisfaction guarantee during the first billing period. If you are unsatisfied with the quality of work delivered during your first month of subscription and no deliverables have been approved or published, you may request a refund of 50% of the first month's subscription fee. This request must be submitted in writing within 7 days of the first delivery and must include specific, actionable feedback describing the nature of your dissatisfaction.

This first-month guarantee is available only once per client and does not apply to subsequent billing periods or to clients who have previously engaged Weblume's services in any capacity.

3.4 Subscription Pauses

If you need to temporarily pause your subscription due to business circumstances, please contact us. We may accommodate pause requests on a case-by-case basis, subject to availability and at our sole discretion. Pausing a subscription does not entitle you to a refund for any portion of the billing period during which the pause was initiated.

4. Circumstances Where Refunds Are Not Available

Refunds will not be issued under the following circumstances:

  • You have approved the final deliverables and subsequently change your mind about the design direction.
  • The deliverables conform to the agreed-upon project scope and creative brief, but you have undergone a change in business strategy, branding direction, or personal preference after delivery.
  • A third party (e.g., a business partner, investor, or consultant) provides negative feedback on approved deliverables.
  • You fail to provide timely feedback, materials, or approvals, resulting in project delays or deliverables that do not meet your expectations due to insufficient input.
  • The request is made more than 30 days after the delivery of the final files for one-time projects.
  • You have violated any provision of our Terms of Service.
  • The design work includes elements that were specifically requested or approved by you during the revision process.

5. Refund Process

5.1 How to Request a Refund

To request a refund, please contact us in writing (email is preferred) with the following information:

  • Your full name and company name (if applicable)
  • The project name or subscription plan
  • The date of payment and the amount paid
  • A detailed explanation of the reason for your refund request
  • Any supporting documentation, screenshots, or communications relevant to your request

5.2 Review and Response

All refund requests will be reviewed by our management team within 10 business days of receipt. We may contact you for additional information or clarification during the review process. You will receive a written response notifying you of the outcome of your request.

5.3 Refund Method

Approved refunds will be processed using the original payment method within 14 business days of approval. Please allow additional time for the refund to appear on your statement, depending on your financial institution's processing times.

6. Dispute Resolution

If you are dissatisfied with the outcome of a refund request, we encourage you to contact us to discuss the matter further. We are committed to resolving disputes amicably and in good faith. If a resolution cannot be reached through direct communication, the dispute resolution procedures outlined in our Terms of Service shall apply.

7. Force Majeure

Weblume shall not be liable for any delay or failure in the delivery of services or the processing of refunds due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, governmental actions, power failures, internet outages, or other force majeure events.

8. Modifications to This Refund Policy

We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting on our website. The refund terms applicable to your project or subscription are those in effect at the time of your purchase or the commencement of your billing cycle. We encourage you to review this Refund Policy periodically.

9. Chargebacks and Disputed Payments

We encourage clients to resolve any payment disputes directly with Weblume before initiating a chargeback with their credit card company or payment provider. Unauthorized chargebacks for services that have been rendered in accordance with the agreed-upon project scope may result in the suspension of services, forfeiture of delivered files, and collection action for any outstanding amounts owed.

If you believe there has been an error in your billing, please contact us immediately so we can investigate and resolve the issue promptly.

10. Intellectual Property Upon Refund

In the event that a refund is issued (whether full or partial), the intellectual property rights of the associated design deliverables shall revert to Weblume. The Client agrees to cease use of all design files, concepts, and materials delivered as part of the refunded project or billing period, and to delete or destroy all copies of such materials in their possession within 7 days of the refund being processed.
